These Terms and Conditions are split into three parts. Part A covers general use of the No Beige Websites website. Part B applies when you hire No Beige Websites for design, development, website rescue or support services. Part C contains the general legal terms that apply to both.

These Terms and Conditions cover general use of our Website and the services we provide to clients.
By accessing this Website or hiring us for services, you agree to these Terms and Conditions in full.
These terms apply to all visitors using this Website.
1.1 Unless otherwise stated, No Beige Websites owns the intellectual property rights for all material on this Website, including text, logos, graphics, case studies, portfolio showcases, images and design layouts.
1.2 You may view and print pages from the Website for your own personal use. You must not republish, sell, rent or duplicate any material from this Website without our express written consent.
2.1 You must not use this Website in any way that causes, or may cause, damage to the Website or impairment of its availability or accessibility.
2.2 You must not use our Website to copy, store, host, transmit or distribute any material which consists of or is linked to spyware, a computer virus or other malicious software.
These terms apply to clients who engage No Beige Websites for design, development, website rescue or support services.
3.1 The specific project deliverables, timelines and fees will be outlined in a separate project proposal, quote or brief.
3.2 Unless otherwise specified in writing, custom web design projects include up to two (2) rounds of design revisions. Any additional changes, structural modifications or feature additions requested outside the agreed scope will be charged at our standard hourly rate of £45 per hour, unless another price is agreed in advance.
3.3 The website will be built and tested for compatibility with current major web browsers including Chrome, Safari, Edge and Firefox. We are not responsible for rendering issues on outdated or retired browser versions.
4.1 Unless otherwise agreed in writing, a non-refundable booking payment of 40% of the agreed project price is required before design, development or website rescue work begins.
4.2 A further 30% of the agreed project price becomes due once the main design direction has been approved.
4.3 The final 30% is due before the completed website is launched, transferred, handed over or final access credentials are released.
4.4 Unless otherwise stated on the invoice, all invoices must be paid within 7 days of issue.
4.5 In accordance with the UK Late Payment of Commercial Debts (Interest) Act 1998, we reserve the right to charge late-payment interest and fixed compensation fees on overdue balances where the legislation applies.
5.1 The Client agrees to provide all required text copy, high-resolution imagery, brand assets, access credentials and other information required for the project within 14 days of project kickoff, unless otherwise agreed.
5.2 If a project is delayed by more than 30 days because the Client has not provided required content, feedback, access or sign-off, No Beige Websites reserves the right to pause the project.
Any work completed up to the date the project is paused may be invoiced in accordance with the agreed project price and work completed.
5.3 A £100 reactivation fee may be charged before a paused project is scheduled back into the active workload.
6.1 All intellectual property rights, source files, custom code and graphic concepts created by No Beige Websites remain the property of No Beige Websites until all outstanding invoices relating to the project are paid in full.
6.2 Upon receipt of final payment, ownership of the agreed final website design and project deliverables transfers to the Client, subject to any third-party licences or services.
6.3 No Beige Websites retains the right to display the completed project, design elements and case studies in our professional portfolio, website and marketing materials, unless otherwise agreed in writing.
7.1 Either party may terminate a project agreement by providing written notice.
7.2 If the Client cancels the project before completion, the initial 40% booking payment is non-refundable.
The Client may also be invoiced for additional work completed beyond the value already covered by payments received, calculated where appropriate at the standard rate of £45 per hour.
8.1 Ongoing website support is not automatically included after project completion unless it is included in the agreed project scope or purchased separately.
8.2 Pay-as-you-go website support is normally charged at £45 per hour.
8.3 Monthly support plans may be offered at the prices displayed on our Pricing page or as otherwise agreed in writing.
Any included monthly support time must be used within that billing month and does not roll over into future months unless specifically agreed otherwise.
9.1 Unless specifically included in writing, the Client is responsible for third-party costs associated with the website.
These may include domains, hosting, premium plugins or apps, business email, booking systems, ecommerce platforms, transaction fees, paid assets and other subscriptions.
9.2 Wherever practical, third-party services should be registered in the Client's own name, held in the Client's own account and paid directly by the Client.
9.3 No Beige Websites is not responsible for third-party price increases, service changes, outages, account restrictions or provider failures outside our reasonable control.
These provisions apply generally to the Website and our services.
10.1 No Beige Websites will make every reasonable effort to deliver a secure and functional website, but we do not warrant that the Website or services will be entirely error-free.
10.2 We are not liable for financial losses, lost revenue, data corruption or business downtime caused by third-party hosting failures, server outages, software or plugin updates, or cyber attacks following launch of the website.
10.3 Our total liability under or in connection with any client project is limited to the total amount paid by the Client to No Beige Websites for that project, subject to any liability that cannot lawfully be limited or excluded.
No Beige Websites does not guarantee specific search rankings, website traffic, enquiries, conversions, sales or revenue.
Website design and development can support a business, but commercial results depend on many factors outside our control.
12.1 These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.
Any disputes relating to these Terms will be subject to the jurisdiction of the courts of England and Wales.
